Please read this Agreement carefully before using the AU Trading website. The Agreement sets out the terms and conditions for using the Websites and placing orders. Using the Websites indicates that you have read and accepted the terms and conditions set out below. We reserve the right to update our terms and conditions without prior notice. If in doubt, please check this page regularly for changes.

The Company reserves the right to change the Terms and Conditions without notice.

Use of the Websites

1.1 We may modify, suspend or discontinue the Websites or the provision of any products under the Websites at any time, including the availability of any features, databases or content, including storage space, upon 90 days written notice to existing customers.

1.2 You are responsible for obtaining and maintaining any equipment or additional services necessary to connect to, access or otherwise use the Website, including modems, hardware, software and long distance or local network services.

Account opening

2.1 In order to use the Websites, place orders and receive products through the Website, you must:

Prices and payment

3.1 The Websites use a live pricing system provided by SuisseChange.com. All prices stated on the website are subject to market fluctuations. When you confirm your order through our website, you are contractually obliged to complete the purchase. In the event of an error in the pricing data provided by SuisseChange.com, incorrect pricing or software malfunction, we reserve the right to either make a new offer or cancel the order. Payment for all orders must be made within two business days. If payment is not received within this time frame, orders may be subject to a new listing or cancellation and refund.

3.2 The Goods will not be released or dispatched until the Company has received full payment of cleared funds via bank transfer.

Order process

4.1 Orders can only be placed directly via the website - telephone orders are not accepted.

4.2 The details provided with each order must be correct and accurate.

4.3 All orders will be confirmed by email within a few minutes of placing the order.

4.4 Your order is an offer to purchase precious metals from us, which is subject to our acceptance. We reserve the right to cancel any order for which payment is not received within two business days.

4.5 All orders are subject to stock/market price verification, payment and availability.

4.6 If the Products ordered are unavailable, the Company will notify you by email using the contact information you have provided. The following options are then available to you:

(i) Wait until the products are back in stock.

(ii) Request for other items of equal value (at the time of order)

(iii) Cancel your order without penalty.

Delivery

5.1 Delivery will be made to the address you provided when ordering. We cannot deliver to PO Box addresses. Orders are only dispatched on working days from Monday to Thursday. Due to shipping insurance policy limitations, we do not ship goods on or the day before public holidays or weekends. Goods will not be released until full payment has been received.

5.2 The delivery charges applicable to your specific order will be clearly stated in the checkout process.

5.3 When the goods are dispatched, you will receive tracking information by email within one working day. It is the buyer's responsibility to be present upon delivery and to sign the goods in person. Claims arising from packages signed for by an unknown person on behalf of the buyer or involving another third party at the delivery address are the responsibility of the buyer. Please note that any packages refused and returned to sender are at the buyer's risk. All claims are subject to acceptance and settlement by our insurers. A copy of our policy is available upon request.

5.4 International shipments may be subject to inspection by local customs authorities or the carrier. We cannot guarantee that "sealed" items will be delivered "sealed" as they may be opened for inspection. Items opened by customs officials will be resealed with official "customs" tape.

5.5 All shipments must be visually inspected before acceptance. If a package appears opened or damaged in transit, it should only be accepted if it has been officially opened and resealed by a government or customs authority. Claims for missing items or missing quantities from damaged or opened packages will not be honored. Before shipping, the contents of all packages are checked by at least two employees.

5.6 If a shipment is refused by the recipient or is undeliverable to the specified address, the customer will be responsible for all return shipping costs and associated customs clearance fees. Return shipping charges are usually a minimum of £50 or equivalent.

Storage

6.1 AU Trading offers physical precious metal storage for customers who wish to keep their purchases safe. The precious metal can be stored, shipped or sold back to the company using the “My Vault” function. The shipment or collection of the precious metal takes place provided that the accounts are in good condition. Vault orders will not be released if there are outstanding payments for storage, shipping, or other outstanding orders. Items can be sold back to the company from storage. Please note that funds can only be transferred to the bank account from which they came.

6.2 If a Customer has Goods in storage, has not logged into their account and has unpaid storage charges for a period of at least three years and the Company has unsuccessfully attempted to contact the Customer:

(i) The Company reserves the right to liquidate the Customer's holdings. This is subject to an administration fee of £150 (or equivalent). (ii) If a Client's position has been liquidated, the Client will have a further calendar year (365 days) from the date of liquidation to contact the Company and arrange the transfer of the remaining Account balance.

6.3 All storage accounts are offered free of charge for the first 365 days. Thereafter, the accounts are subject to a monthly fee in accordance with the vault storage fee schedule. It is the customer's responsibility to ensure that account fees are paid on time. Accounts with arrears are subject to a fee of £10 (or equivalent) or 1% of the outstanding balance per month. Fees will continue to be charged until outstanding account fees are paid.

6.4 If a Customer refuses to pay Account Fees, the Company reserves the right to:

(i) Refuse further business dealings with the Customer, including processing withdrawals, transfers, deliveries or new order requests.

(ii) Sell part of the customer's inventory to cover the outstanding debts.

(iii) Terminate the business relationship with the customer. In the event of termination of the business relationship, AU Trading will grant the customer a period of 30 days during which the customer can settle his outstanding debts. After 30 days, all open positions will be liquidated and funds will be transferred to the client at the current purchase rate offered by the company.

6.5 In the event that a Customer's inventory bill exceeds the value of its Precious Metals Account, the Company reserves the right to liquidate the Customer's holdings to settle the outstanding debt.

6.6 All precious metals in storage are only insured against theft and damage caused by fire, flood or explosion.

Cancellation

7.1. We reserve the right to cancel any order at our sole discretion.

7.2 The buyer's right to cancellation in accordance with the provisions of the Distance Selling Act (if applicable) does not apply as the goods supplied by us are subject to fluctuations in the financial market and are therefore excluded from the right to cancellation. Failure to comply will result in customers being liable to pay a cancellation fee of £100 as well as any difference in the price of the underlying asset.

7.3 If the Customer cancels or fails to fulfill an order without the express authorization of the Company, this will result in the account becoming overdue.

Privacy Policy

8.1 The personal information you provide will only be used by us in accordance with our Privacy Policy, which can be accessed by clicking on the hyperlink at the bottom of each page on the Websites.

Liability for market information and availability of the websites:

9.1 You use the websites at your own risk. The Content is provided to you “as is” and without warranty of any kind, express or implied. We disclaim all warranties, including warranties of merchantability, non-infringement and fitness for a particular purpose. In particular, we give no guarantee that the content of the website is error-free and that all updates are made in a timely manner.

9.2 We will not be liable for any damages of any kind arising from the use or inability to use the Websites, whether from the purchase of goods or services through the Websites or from content posted by us or others on the Websites. We will not be liable for any indirect, incidental, consequential, special or punitive damages of any kind, including, without limitation, loss of profits, loss of use, loss of data or other intangible damages, even if we were aware of the possibility of such damages.
